AUCTION PROCEDURE 

Register online to get a bidding number. 

REGISTRATION

By completing the registration process to bid, Buyer affirms that Buyer has reviewed, comprehended, consented and agrees to all the Terms & Conditions provided herein. Buyer is accountable for all bids made from Buyer’s computer or through buyers bidder account. Should a winning bid be placed from Buyer’s computer or via your bidder account, Buyer will be recognized as the Buyer upon verification by the Auctioneer. Buyers are encouraged to contact the Seller in order to inspect items and for greater details and/or disclosure on any items prior to the auction. 

Highest bidder makes full settlement within 3 business days after the conclusion of the auction. 

The Auctioneer reserves the right to revoke any bid number at any time, even during the auction. 

Items may be removed from the auction site or Seller’s premises upon presentation of paid-in-full invoice from the Auctioneer. Buyer must prove their identity prior to loading and removal of their items from the premises.

All Fast Bid Auctions are Public Auctions open to the Public

All Bidders must be 18 years of age or older to register and be in good standing with the Auctioneer in order to bid on items listed on online or onsite auctions and on “equipment for sale” auction listings. The Auctioneer reserves the right to remove a bidder for not complying with the Terms and Conditions prior to bidding or during the auction process, if needed. 

PAYMENT TERMS 

All purchases must be paid for within 3 business days after the conclusion of the auction. Cash, credit card up to $7,500, certified check, wire transfer or personal check/company checks if they are accompanied by a guarantee from your bank.  No merchandise will be removed until complete settlement is made.  A 15% Buyer's premium will be charged to all items selling. If items are not paid for by the following business day after the auction, the buyer hereby gives permission to the Auctioneer to charge the credit card on file which was provided at registration to complete the transaction. Your credit card on file will be subject to a pending $1 charge. This is not a deposit and will not post to your credit card statement, it is just a pending charge.  

Credit card payments will be accepted only for invoices totaling $7,500 or less. For any invoice exceeding $7,500, Buyers must remit payment via wire transfer, cashier’s check, cash, or personal/company checks accompanied by a verifiable bank letter of guarantee.

Splitting payments across multiple credit cards or transactions to circumvent the $7,500 limit is strictly prohibited. Auctioneer reserves the right to decline, reverse, or hold any payment not made in accordance with these terms.

Auctioneer further reserves the right to modify payment policies at its sole discretion, with or without prior notice.

PICKUP, PAYMENT, AND IDENTITY VERIFICATION REQUIRMENTS

Only the registered bidder listed on the winning invoice is authorized to retrieve auction items. A valid, government-issued photo ID must be presented at the time of pickup and allow Auctioneer to retain a photograph of bidder holding their ID.

If the registered bidder is unable to attend pickup in person, a written authorization designating an alternate pickup representative must be provided to Auctioneer in advance. The authorized representative must also present a valid photo ID at pickup and allow the auctioneer to retain a photograph of the representative holding their ID.

For invoices being paid by credit card, the cardholder must be present at pickup and provide a matching valid photo ID. Credit card payments must be processed in person; remote or third-party payments are not accepted unless pre-approved in writing by Auctioneer.

The name and billing address associated with any credit card used must match the registered bidder’s account information on file. Use of a credit card issued to another individual or entity (such as a spouse, employer, or business partner) is permitted only with prior written approval from Auctioneer. Buyers must request such approval before the auction closes and provide any necessary documentation if requested.

Payments that do not meet these criteria are subject to additional verification and may be declined, refunded, or held at Auctioneer’s sole discretion. Auctioneer reserves the right to delay the release of items pending successful payment and identity verification.

Items will not be released to individuals who cannot be verified as the winning bidder, the authorized representative, or the verified cardholder. Suspected misuse of credit cards may result in account suspension and notification to the appropriate authorities.

This policy is intended to protect both the Buyer and Auctioneer against fraudulent or unauthorized transactions.

 SALES TAX 

The Buyer is responsible for all applicable sales tax on items purchased in all auctions. Sales tax guidelines from the applicable state will be used to determine if an item is sales tax exempt. If the exempt determination is made, the Buyer will be responsible for obtaining, completing, and forwarding all necessary forms from the taxing jurisdiction (e.g., city, county, state) to the Auctioneer. All tax documentation must match the Buyer’s account details and invoices cannot be changed after the auction has closed. Sales tax can only be cleared from the Buyer’s invoice once all required forms have been completed, submitted, and validated. Sales tax or appropriate sales tax exemption forms are due to the auctioneer prior to bidding. No items will be released to the Buyer until payment is received in full by the Auctioneer. Payment in full includes the payment of all applicable sales tax or the submission of all appropriate sales tax exemption forms as well as the Buyer’s premium. 

TAX, LICENSES 

All sales are subject to the sales tax and/or other applicable tax laws. Buyer assumes all responsibility for government issued licenses and/or inspection certificates as well as all required or associated licensing and inspection costs. Buyer agrees not to use any identification, trade name, licenses, and/or certificates belonging to or used by Seller or Auctioneer. 

REMOVAL 

It is the Buyer's responsibility to pick up or arrange pick up of items purchased in auction from Auctioneer or Seller’s location within ten (10) business days of winning the bid. Transportation, and any and all costs associated, will be borne by the Buyer. Should Buyer fail to remove purchased items within the specified period of time, the Auctioneer will charge a storage fee of $10 per day, per lot until purchase is removed from the auction. All such charges shall be the sole responsibility of the Buyer. The Buyer or the Buyer’s agent is responsible for arriving with a paid in full invoice and the appropriate equipment to safely transport the item purchased. If the transportation equipment to be used is viewed as unsafe, the Buyer or the Buyer’s agent may be turned away without the item, at the Buyer’s expense. The Buyer agrees to indemnify and hold harmless Seller, Auctioneer, and its agents against all damages, liabilities, claims, or causes of action arising out of said property storage and removal. After 30 days of storage all items will be forfeited even if item has been paid for. The Auctioneer also maintains the right to suspend the bidding privileges of any Buyer who does not pick up items purchased in the auction within the specified terms. 

Buyer is solely responsible for ensuring that all items being transported are properly secured and carried in compliance with all applicable vehicle and transportation laws and regulations, and that Auctioneer shall not be held responsible for the securing of any loads.

CERTIFICATE OF TITLE INFORMATION 

 

Buyer appoints Auctioneer as its agent to accept delivery of the properly executed, marketable state-issued Certificate of Title with recorded liens properly released if known. Buyer will be contacted via email regarding titling information. Auctioneer requires all title information including name(s) and complete address be communicated through email or any other written form, for our records. All titles will be endorsed as directed – no open titles will be issued. Title will be forwarded to Buyer via certified US Mail or equivalent no sooner than fourteen (14) days after receipt of complete payment, unless otherwise noted in item description, regardless of payment type. There is a $25 title processing fee, charged to the Buyer, on all titled items. Auctioneer is not responsible for any lost titles. 

WARRANTIES – EQUIPMENT SELLS WITHOUT WARRANTIES 

To the fullest extent permitted by law, the sites, services, and items sold by or through the Auctioneer are provided without warranties, express or implied, of any kind including without limitation implied warranties of non-infringement, merchantability, condition (whether or not discoverable or concealed in factory packaging), usability, fitness for a particular purpose, or as to brand, identity or quality of the unit, materials, components, or workmanship. 

While the Auctioneer makes every effort to represent the equipment to the best of their knowledge, the Auctioneer makes no warranty or guarantee of the equipment. While every effort is made to convey verbal and written information, photos, and descriptions accurately, these are meant to be used only as guides. Auctioneer Representatives are not professional photographers. Photos may or may not depict all the good and bad ASPECTS of items. Photographs of unused items may be from a similar unused item and it is the buyers responsibility to inspect the actual item at preview prior to bidding.

NO OPERATIONAL ASSESSMENT IS PROVIDED BY THE AUCTIONEER 

No testing or operational assessments have been made on items sold through the Auctioneer. Auctioneer only reports hours and miles that are shown on the meter at the time of listing for auction and makes no guarantees that the miles/hours shown on meter are the actual miles/hours. Items that require an electrical connection to operate have not been tested and there is no guarantee as to performance.

BUYER RESPONSIBILITY TO INSPECT AND DETERMINE SUITABILITY FOR USE AND ITEM LOCATION

It is the responsibility of Buyers to inspect an item prior to bidding in order to assess the items operational condition, and suitability for use. Seller's contact information and location of the item will be provided with a listing description of each item for sale. Potential Bidders should contact the Seller for the exact location of an item, along with directions, and inspect the item before bidding. In no event does failure to contact the Seller or failure to inspect an item prior to bidding serve as grounds for collapsing the sale, rescinding the transaction, or requesting a rebate or refund. Auctioneer often sells items that are located and will be required to be picked up by buyer at various locations.

BUYERS RESPONSIBILITY TO DETERMINE SUITABILITY FOR USE REGARDING EMISSIONS 

It is each Buyers responsibility to verify and determine if an auction item including vehicles and equipment meets the emissions requirements in the County and State for which the item is to be utilized. Although, Auctioneer may provide notations or information as to emissions compliance it cannot be relied upon by the Buyer, and it is the Buyers ultimate responsibility to verify emissions compliance. No refunds or deductions will be provided to the Buyer for the lack of an item being able to comply with any emissions requirement.  It is common that that any item with a diesel engine may not be operated in the Stae of California regardless of age. All items with two stroke engines are strictly sold for use outside of the state of California. If a resident of California purchase any of these items mentioned above they hereby agree to remove these items from the state of California prior to operation.

FAILURE TO INSPECT 

It is each Buyers responsibility to inspect items. We encourage you to email, call, or show up to the preview to inspect items and gather more information. Failure to inspect an item prior to bidding is not grounds for a dispute, refusal to pay or refusal to take possession of the purchased item. If after reviewing a claim, in the Auctioneer's judgement there is no grounds for dispute, the transaction will be considered closed. Refusal to take possession of the unit at that point will result in forfeiture of the purchase price. The includes items that are concealed in packaging.

AUCTIONEER IS NOT RESPONSIBLE FOR VERBAL OR WRITTEN SELLER STATEMENTS 

Auctioneer is not responsible for statements, written or verbal, made by the Seller. Buyer should carefully validate all such statements by inspecting the item prior to bidding. Failure to inspect the item is not grounds for dispute. Bidder is to use their due diligence prior to bidding, as no bids will be retracted. There is no refund for any reason. Buyer is fully aware there is no recourse to rescind or abrogate the transaction after becoming the highest bidder. This includes items that are concealed in packaging.

COLLAPSED SALE 

A "Collapsed Sale" shall be a sale that for any reason becomes null and void. You acknowledge that the Auctioneer reserves the right to collapse any sale between you and the Seller for any reason and may return any or all funds to you. 

FAILURE TO PAY/BUYER PAYMENT DEFAULT 

If a Buyer fails to pay for an item, they are subject to collection on the full purchase price and any associated taxes and fees, or if the item is sold to the second highest bidder or relisted by the Seller, any shortfall in resale price plus 25% of the final sale price in liquidated damages. Failure to pay will also result in the Buyer’s account being suspended from participation in all future auctions.

ABANDONMENTS 

Should Buyer fail to remove purchased items within ten (10) business days of winning the bid, Buyer agrees to pay a storage fee of $10 per day, per lot until the items are removed from Auctioneer or Seller’s location. All such charges shall be the sole responsibility of the Buyer. The Buyer agrees to indemnify and hold harmless; Seller, Auctioneer, and its agents against all damages, liabilities, claims, or causes of action arising out of said property storage. If Buyer fails to remove the purchased item(s) within thirty (30) calendar days of winning the bid, Buyer stipulates and consents to the fact that said purchased items shall be considered “abandoned”. 

In the event the sale price of said items not removed was $1,000 bid price or less, Seller may dispose of said items as Seller, in Seller’s sole discretion, sees fit without remuneration of any kind to Buyer. In the event the sale price of said items not removed exceeds $1,000 bid price, Buyer and Seller agree said items will be placed for sale in the next auction. In furtherance thereof, Buyer hereby irrevocably appoints Seller as its power of attorney for the purpose of re-listing and re-selling said abandoned property in such case, Buyer consents to and agrees that all storage fees, handling costs, sales commissions, and a 20% administration fee for the “re-sale” of the items will be deducted from the final sale price and Buyer authorizes Auctioneer to make such deductions. Buyer, in such event, authorizes Seller, on its behalf, to transfer ownership/title to the new buyer and Buyer agrees and acknowledges that any ownership interest Buyer has in said items shall then terminate. 

In the case of titled vehicles, Buyer agrees to promptly return the title for said vehicle to Auctioneer within 7 days after said vehicle has been considered abandoned by these terms. In the event Buyer fails to do so, Buyer hereby irrevocably appoints Seller as its power of attorney for the purpose of applying for a lost, or other such replacement title, including any associated paperwork needed to obtain such title, so as to allow for the disposition or re-sale thereof. In the event of re-sale, upon receipt by Auctioneer of such resale amount, any proceeds remaining after the deductions as set forth herein, will be returned to the abandoning Buyer, provided Auctioneer is able to determine a method for doing so. It shall be the duty and responsibility of Buyer to keep the Auctioneer updated on Buyer’s correct contact information. Buyer agrees to indemnify and hold Auctioneer harmless from Buyer’s failure to timely remove the purchased items as agreed, as well as for Buyer’s failure to keep Auctioneer updated on Buyer’s current contact information. Auctioneer also maintains the right to suspend the bidding privileges of any Buyer who does not pick up item purchased in the auction within the specified terms. 

Entering into a separate storage agreement with the Seller is between the Buyer and Seller, and Auctioneer has no responsibility for resolving any subsequent conflicts or disagreements which arise between Buyer and Seller. 

ACCESS TO FASTBIDAUCTIONS.COM WEBSITE 

Auctioneer does not guarantee uninterrupted, secure access to FastBidAuctions.com. Auctioneer is not liable or responsible for interruptions, terminations, or corruptions of any online audio feed, video feed, or other internet registration, bidding, or other online-related services that occur before, during, or in connection with the online or onsite auctions, regardless of the cause or fault. Buyer agrees to hold Auctioneer harmless for any such interruptions or Buyer’s inability to effectively use FastBidAuctions.com. 

Auctioneer reserves the right to prevent, disable, and or suspend users access or use of FastBidAuctions.com or any of the family of sites, either on a temporary or permanent basis for any reason, including and not limited to the reasons mentioned previously or for any activity that imposes a risk to the safety or security of our site experience. 

NO CREDIT CARD CHARGEBACKS

Buyer agrees that Buyer will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the auction. Buyer further agrees that if, in violation of these Terms & Conditions, a credit card chargeback is initiated, these Terms & Conditions will be conclusive evidence of Buyer’s agreement not to initiate a credit card chargeback; and Buyer acknowledges and agrees that on the presentation of these Terms & Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Terms & Conditions, Buyer initiates a credit card chargeback, even if successful, Buyer will remain liable for all purchases made at the auction, and Buyer will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller in challenging the credit card chargeback and in collecting payment. Buyer’s agreement not to initiate a credit card chargeback is a condition to Buyer Registration as a Bidder, and for the privilege of bidding at the auction, and is being made as an inducement for Auctioneer to accept Buyer Registration and to permit Buyer to bid at the auction. Auctioneer is relying on Buyer agreement not to initiate a credit card chargeback in accepting Bidder Registration and in permitting Buyer to bid at the auction.


Auction Format and DMV Dealer License Disclosure

Fast Bid Auctions, LLC is a licensed California motor vehicle dealer (CA DMV Dealer #80091) and conducts sales in two formats: (1) sales made through public auctions and (2) dealer retail or wholesale transactions where applicable. Buyer acknowledges that vehicles sold at public auction may be subject to exemptions under California Vehicle Code §24007.5, including exemptions from smog certification, safety inspections, and other dealer obligations. Where vehicles are sold under the dealer license outside of auction exemption parameters, standard DMV rules will apply, and such will be disclosed in the item listing or sale documentation.

Consignor Bidding Policy
Fast Bid Auctions conducts all vehicle and equipment sales as public auctions in accordance with California Vehicle Code §24007.5. All Lots are sold to the highest bidder. On certain Lots, consignors may participate in bidding on their own items; however, consignor bidding must be made through a registered bidder account, and is subject to the same Terms and Conditions, fees, and binding purchase obligations as any other bidder.

No Lot may be subject to a reserve price or seller approval once the auction begins. All sales are final upon the fall of the hammer, and Fast Bid Auctions will not stop or reverse bidding activity to accommodate consignor preferences. This policy is intended to preserve the integrity of a bona fide public auction and to maintain eligibility for DMV and emissions exemptions as permitted under California law.

DMV Compliance Based on Sale Type

For sales conducted as public auctions, Buyer understands and agrees that certain DMV requirements—including smog certification, safety inspection, and dealer disclosures—may not apply pursuant to California Vehicle Code §24007.5. For retail sales made under Fast Bid's dealer license (e.g., certain titled vehicles sold outside auction or requiring DMV processing), Buyer will receive necessary documentation in compliance with DMV requirements, including title transfer and sales tax processing where applicable. Fast Bid will indicate sale type and processing details in the lot description or final invoice. Buyer understands that they are taking a risk that any vehicle purchased may not pass a smog or safety inspection and buyer agrees not to operate the vehicle until they have repaired it as necessary to meet smog and safety requirements. If sale type is not indicated it is hereby made under the exemptions per California Vehicle Code §24007.5.

Smog and Registration Disclosures – Dealer vs. Auction Sales

Buyer acknowledges that not all vehicles or equipment sold by Fast Bid Auctions, LLC are subject to smog inspection, registration pre-clearance, or safety certification prior to sale. Vehicles sold through public auction may qualify for exemption from certain DMV dealer requirements. Buyer is solely responsible for determining road-worthiness, emissions compliance, and DMV eligibility for operation or transfer of title. Auctioneer shall not be liable for any delays or denials arising from Buyer’s attempt to register or smog vehicles after purchase.

DEALER STATUS AND DMV COMPLIANCE

Fast Bid Auctions, LLC is licensed by the California Department of Motor Vehicles (Dealer #80091) and conducts both public auction sales and retail/wholesale dealer transactions. Buyer understands that some vehicles sold via Fast Bid may be processed under DMV auction exemptions (pursuant to Cal. Veh. Code §24007.5), while others may be processed under standard dealer rules. Fast Bid will indicate the applicable method of sale and associated DMV responsibilities where relevant. Buyer agrees that it is their sole responsibility to ensure DMV compliance, registration, and emissions suitability for their intended use, and that all items are sold “as is, where is” with no warranty unless otherwise stated. Buyer agrees to determine if there are back fees due prior to bidding and agrees that that are taking responsibility for any back fees due upon acceptance of these terms and conditions.

Diesel Emissions Restrictions for California Use
Certain diesel-powered vehicles, trucks, or equipment sold by Fast Bid Auctions, LLC may not be eligible for registration, operation, or use within the State of California due to emissions restrictions enforced by the California Air Resources Board (CARB). Buyer acknowledges that it is their sole responsibility to determine whether any diesel-powered item complies with applicable CARB regulations prior to bidding or purchase. Fast Bid Auctions makes no warranty or representation regarding emissions compliance or eligibility for use in California. No refunds, returns, or cancellations will be accepted due to non-compliance with CARB or other emissions-related restrictions.

No Warranty on Plants, Animals, or Perishables

Fast Bid Auctions makes no warranty as to the health, survival, or condition of any live plants or animals sold at auction. Buyer assumes all risk upon completion of the auction and must make appropriate arrangements for transport, care, and environment.

No Warranty on Fluids or Fuel Levels

Fast Bid Auctions makes no representation or guarantee as to the presence, quantity, or quality of any fuel, chemicals, or other liquids contained in tanks, reservoirs, or containers. Buyer assumes all risk and liability for removal, transport, use, or disposal. Buyer accepts responsibility to property add all required fluids to equipment and or vehicles prior to use.

Load Securement Responsibility

Buyer is solely responsible for ensuring that all items are properly secured, tied down, and transported in accordance with applicable state and federal laws. Fast Bid Auctions shall not be liable for any damage or injuries arising from improper load securement. Buyer agrees to tie and secure all items prior to transport.

Hazardous Materials Compliance

Buyer agrees that any item containing hazardous substances, including chemicals or paint, shall be handled, transported, and disposed of in accordance with all applicable hazardous materials regulations. Buyer is solely responsible for legal compliance. Buyers also acknowledges that treated lumber may be considered hazardous and it is buyers responsibility to utilize or dispose of treated lumber per all governmental requirements.

No Use by Minors

No item sold through Fast Bid Auctions shall be used, operated, or accessed by individuals under the age of 18. Buyer agrees to restrict access and use of such items to qualified adults only.

Container Inspection Prior to Departure

Buyer is responsible for inspecting the interior of any purchased container or enclosed item before leaving the auction site. Fast Bid Auctions is not responsible for undisclosed contents or damages discovered after departure. Buyer agrees to return any items that were concealed or unidentified prior to departure from the pickup location.

Obligation to Return Misidentified Items

If Buyer departs the auction site with any item that was not listed under their invoice or not intended for them, Buyer agrees to return such item promptly and is liable for any damages, losses, or expenses resulting from the misappropriation.

No Emissions Compliance Guarantee

Fast Bid Auctions does not guarantee that any item complies with California Air Resources Board (CARB), EPA, or other local or state emissions regulations. Buyer is solely responsible for verifying compliance before using the item in a regulated jurisdiction.

Hour Meter Disclaimer

Any hour meter or odometer readings provided are based solely on the physical reading at the time of listing and are not verified. Fast Bid Auctions does not guarantee the accuracy or functionality of any meter or counter.

Tax Exemption Documentation Requirement

All tax exemption certificates must be submitted and validated prior to bidding. Expired, incomplete, or post-sale exemption claims will not be honored. Buyer agrees to pay all applicable taxes unless exempt status is confirmed in advance.

Illegal Use Prohibited

Buyer agrees not to use any item purchased through Fast Bid Auctions for the manufacture, storage, or transportation of illegal substances or to engage in any activity that violates local, state, or federal law.

DMV Lien and Registration Disclaimer

Fast Bid Auctions makes no guarantees regarding the existence of outstanding liens, back registration fees, or penalties associated with any DMV-regulated items. Buyer is responsible for verifying title status and associated DMV obligations.

No Guarantee of Accurate Serial or ID Tags

Buyer acknowledges that serial numbers, VINs, model tags, decals, and other identification markings may be missing, incorrect, altered, or illegible. Fast Bid Auctions makes no warranty as to the authenticity or accuracy of such labels.

Bill of Sale Only Disclaimer

Buyer acknowledges that items marked as 'Bill of Sale Only' are not titled and may not be eligible for future registration. Buyer agrees that such items labeled “Bill of Sale Only” are purchased strictly for parts, salvage, or off-road/private use and will not attempt to be registered.

Paints and Chemicals Usage Restrictions

Buyer agrees that any chemical and/or paint-based product will only be used in a legally approved location and, if not used, shall be disposed of in accordance with all federal, state, and local hazardous waste regulations.

OSHA Compliance Disclaimer

Buyer agrees not to operate or place any equipment into service until it has been brought into full compliance with all applicable OSHA safety standards. Buyer assumes responsibility for any injury or citation resulting from non-compliant use.

No Building Code Warranty

Fast Bid Auctions makes no representation that any structure, facility, portable building, or modular unit complies with current building codes regardless of what is noted on the items packaging. Buyer is solely responsible for permits, approvals, or retrofitting as needed for legal occupancy or installation. Buyer recognizes that most counties in California do not allow the use of an accessory building or structure over 120 square feet without governmental approval and in many locations no accessory builds or structures are allowed.

Governing Law, Venue, and Attorney's Fees

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California. Buyer agrees that the exclusive venue for any dispute, claim, or legal proceeding arising out of or relating to any auction conducted by Fast Bid Auctions, LLC shall be the County of San Luis Obispo, State of California. In the event of any dispute between Buyer and Fast Bid Auctions, the prevailing party shall be entitled to recover all reasonable attorney’s fees, costs, and expenses incurred.

Limitation on Auctioneer Representations

No statements, representations, or warranties made by any auctioneer, employee, or representative of Fast Bid Auctions, either oral or written, shall be binding unless explicitly set forth in writing in these Terms and Conditions or the listing description. Buyer agrees not to rely on any such statements in making bidding decisions.

Technology Failure & Interruption Disclaimer

Fast Bid Auctions is not responsible for technical failures, lost connections, interrupted service, bidding platform malfunctions, or delays in bid transmission, regardless of cause. Buyer acknowledges and accepts that bidding over the internet or mobile devices involves inherent risks, and assumes all such risks voluntarily.

Force Majeure Clause

Fast Bid Auctions shall not be held liable for any delay or failure in performance caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, power outages, government actions, labor disputes, or cyberattacks.

Payment Source Verification and Anti-Fraud

Fast Bid Auctions reserves the right to request verification of identity, proof of billing, or confirmation of payment source before releasing any purchased item. Failure to comply with verification requests may result in cancellation of the transaction and forfeiture of bidding privileges at the discretion of the auctioneer.

No Title Guarantee for Non-Titled Items

For any item sold without a Certificate of Title, Fast Bid Auctions makes no representation as to ownership history, prior liens, registration eligibility, or legal compliance for operation. Buyer assumes full risk and responsibility for ensuring lawful ownership and use of the item.

Disclosure of Buybacks or Seller Bidding

Some Lots may be subject to buyback or bidding by the consignor or its agents. Such activity is legally permissible in public auctions. Fast Bid Auctions may disclose such activity at its sole discretion but is under no obligation to do so. All activity complies with auction law and is disclosed per UCC § 2-328.

Liquidated Damages Clause for Buyer Defaults

In the event of Buyer’s failure to complete payment, Buyer agrees to pay liquidated damages equal to 25% of the full invoice amount in addition to any deficiency resulting from resale of the item(s). This provision does not limit Fast Bid Auctions’ right to pursue actual damages where appropriate.

Limitation of Liability
To the fullest extent permitted by law, the total liability of Fast Bid Auctions, LLC, its affiliates, agents, employees, or representatives, for any and all claims, damages, losses, or causes of action arising out of or relating to any transaction, auction, or item shall be limited to the lesser of (a) the purchase price actually paid for the item at issue or (b) one thousand dollars ($1,000). In no event shall Fast Bid Auctions, LLC be liable for any indirect, special, incidental, or consequential damages, including but not limited to lost profits, business interruption, loss of data, or loss of use, regardless of the legal theory under which such damages are sought, and even if advised of the possibility of such damages.
